A proposed $2.8 billion settlement has been reached between the Blue Cross Blue Shield Association (“BCBSA”) and healthcare providers. It resolves claims that BCBSA violated antitrust laws by dividing service areas and fixing prices.

Who Is Eligible?
You may be eligible if:
- FAQ No. 4: “The Settlement Class includes all Providers in the U.S. (except Excluded Providers (see FAQ 5), who are not part of the Settlement Class) who currently provide or provided healthcare services, equipment or supplies to any patient who was insured by, or was a Member of or a beneficiary of, any plan administered by any Settling Individual Blue Plan during from July 24, 2008 to October 4, 2024 (“Settlement Class Period”).
You are not eligible if:
- FAQ No. 5: “Providers that have otherwise fully released their Released Claims against the Releasees prior to the Execution Date, including but not limited to Providers that were members of any of the settlement classes in Love v. Blue Cross and Blue Shield Association, No. 1:03-cv-21296-FAM (S.D. Fla.), and who were licensed to practice before March 12, 2008;”
- You exclusively provided: prescription drugs; durable medical equipment; medical devices; services in an independent clinical laboratory; or services, equipment, or supplies covered by standalone dental or vision insurance.
- Your practice is owned by, or you are employed by any of the Settling Defendants.
- Your practice is owned by, or you are employed exclusively by government entities or those that exclusively provided services to members of Medicare, Medicaid, or the Federal Employee Health Benefits Programs.

- Claim Submission: Submit your claim before the Final Approval Hearing on July 29, 2025
How the Settlement Fund Will Be Allocated: FAQ 7
- Total Settlement: $2.8 billion
- Allocation: 92% of the net settlement fund [after attorneys’ fees and expenses and notice and settlement administration costs] will go to hospitals and facilities, and 8% to individual providers.
What You Should Do:
- Check Eligibility: Confirm if you qualify based on the included and excluded criteria.
- Submit a Claim: If eligible, complete the Professional Claim Form at www.bcbsprovidersettlement.com by the July 29, 2025, deadline.
- Decide on Participation: If you want to exclude yourself or object, submit your request by March 4, 2025.

This is the result of years of litigation that began in 2012 and while BCBS denied the allegations, it agreed to the settlement and to make operational changes that would lead to more transparency, efficiency and accountability.
